These Terms and Conditions govern the use of the Company`s website and all applications, software and services (collectively, “The Services”) available via this website.
1.1. The user warrants to the Company that the Company is legally entitled to make use of information provided via the website.
1.2. The Company reserves the right at its sole discretion to change these Terms & Conditions at anytime and/ or any section of this website for any reason and at any time, without prior notice to its users.
1.3. Changes to these Terms & Conditions and website will be effective immediately when posted. The continued use of this website and its Services after any changes will take place shall constitute the user’s acceptance of it.
1.4. All the information, tools and materials contained in this website are not directed to, or intended for distribution to or use by any person or entity who is a citizen or resident of or located in any jurisdiction where such distribution, publication, availability or use would be contrary to law or regulation or which would subject the Company or its affiliates to any registration or licensing requirement within such jurisdiction. By accessing any part of this website, the User agrees not to use this website in such a way that disrupts, interferes with or restricts the use of this website by other users; not to upload, display or transmit any materials through this website which are false, offensive, defamatory, threatening, obscene, unlawful or which infringe the rights of any other person anywhere in the world.
2.Intellectual Property Rights
2.1. The trademarks, names, logos and service marks displayed on this website and its platforms (collectively “The Trademarks”) are registered and/or unregistered trademarks of the Company and its third parties have rightfully permitted the Company to display them on the Website and/ or on the platforms. Nothing contained on this website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on the Website and it`s platforms without the written permission of the Company.
2.2. The website and platform content may be downloaded for customer`s personal use and for non-commercial purposes but no modification, further reproduction of the content is permitted. The content of the website, included but not limited to images, text, executable codes, layout design, audio, and video may not be distributed, modified, duplicated, transmitted, reused, re-posted without a prior written consent from the Company. Anything that the user uploads, posts or transmit to this Website and its platforms may become the property of the Company and may be used by the Company for any lawful purpose, and is further subject to disclosure as deemed appropriate by the Company, including to any legal or regulatory authority to which the Company is subjected to.
3.Applicable Law and Jurisdiction
3.1. All disputes that may arise between the parties in respect to this Agreement and/or its implementation and/or in respect to the Company shall be deliberated before an accepted single on-line Bulgarian arbitrator. The Company shall have the right to bring legal procedures against the Client, in order to collect funds owed by the Client to the Company or to protect its reputation, good name, Intellectual property or confidentiality rights, in the applicable courts at the Client’s jurisdiction and governing law there.
- Fees Paid
Fees paid to the Company are to compensate for the work performed by the company. In addition, the company will pay the consultant fee for one visa application, which visa is the one defined by the program purchased by the client. All other fees and incidentals, charged by any party including the RCIC or the government or any third-party providers, not specifically stated as being paid, are the obligation of the client.
5.1. Once a client profile is completed and sent for an evaluation by the Regulated Consultant, despite the outcome of it, a refund request will not be accepted.
5.2. Any Refund shall be requested within 3 business days from the date of purchasing the Services, unless clearly expressed otherwise in the Terms & Conditions.
5.3 In the event of submission by the RCIC and refusal of the Canadian government of the application, the client shall receive a 10% refund of money paid in Step 2, visa purchase, as liquidated damages.
5.4 Paragraph 5.3 does not apply to Visitor Visas and to Business Visas.
5.5 The client may place his account on hold one time only. This will allow for the account to be placed in dormant condition for a period of less than 180 days total. The client must re-open his case within this 180-day period and there will be no penalty. If the period passes, then the company will close the file and there will be no credit given to the client and should client decide at a later date to commence the application, s/he shall pay the full fee again. The client may request an extension of the 180-day period for a further 180 days. Such request must be made in writing and submitted to the company prior to the expiration of the first 180-day period. You must sign into your profile at least once during the hold period in order to extend the period.
5.6 In the following situations the fee is 100% non-Refundable:
- Failing of medicals by the client or his/her relative included in the application.
- Failing to provide an authentic Police Clearance Certification. The certificate should not be less than 3 months old.
- Failure to show ample funds for settlement or maintenance by the customer or his/her relative included in the application.
- Submission of deceptive documents.
- Late entry of any sort of documents, either during regular processing or additional documents requested by the consulate at a later phase.
- The client falls short of fulfilling the language proficiency requirements as pointed out in the assessment report.
- Visitor Visas , IEC (PVT) and All Business/Entrepreneur/Self-employed/Investor Visas programs are nonrefundable.
5.7 Refund policy for purchase of services that require use of a third-party service:
- The purchase price may be refunded on a pro-rata basis prior to contacting the third-party for provision of services. This is subject to company investigation into the reason for the refund request. Such a request must have a reasonable justification.
- Once the information has been transmitted to the third-party then no refund is possible.
5.8 In cases that a Refund is approved, the Company shall refund the Client with the agreed amount minus 45€ for finance charges and a 55€ Service Fee.
5.9 Refunds will be sent out by the company within 7 business days of final approval for a refund.
6.Disclaimer of Warranties
6.1. The use of the website is at the User’s own risk. The information on this site is provided on “as is” and “as available” basis.
6.2. The company does not warrant the accuracy, completeness, security or timeliness of the content, information or services provided on or through the use of the website and its platform, either expressly or impliedly, for any particular purpose.
6.3. The company, its officers, licensors, suppliers and employees, to the fullest extent permitted by law, disclaim all warranties express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties’ rights, and fitness for a particular purpose.
6.4 The company shall not be responsible or held liable for any disturbances or malfunctions that any of the company’s Websites or Offered Products or Software may cause to any other software or application, or to any computer hardware system or any part thereof, including any information or data contained in such.
- No guarantee of Visa Acceptance
7.1 You understand that the company’ evaluation is a based on an evaluation procedure and there is no guarantee a visa will be granted. All applications submitted receive an equal treatment by the Canadian authorities.
7.2 The company is not involved in any way in issuing immigration visas. We use selected RCIC members and lawyers for the purpose of presenting applications before the Canadian Authorities.
- Authorized Representatives
8.1 The user acknowledges that the company at its sole discretion, may grant limited access to its websites and/or servers, to third party Canadian immigration practitioners who are authorized representatives under Canadian law for the purpose of supplying Canadian immigration services for a fee. The user grants the Company the right to agree to the terms of engagement with these Consultants for an Initial Assessment as the agent of the user. This Initial Assessment is based on information supplied by the client and not verified by the company or the RCIC and is subject to final verification when the file is transmitted to the RCIC and submitted to the government.
The grant of such access to the company websites and/or servers does not establish consultant-client or attorney-client relationship between the user and the authorized representatives. Only upon the signing of a release form to the company and a Retainer agreement with the RCIC or lawyer shall such a relationship exist.
Qualified users/clients who are seeking services which fall within the scope of Section A91 of the Immigration and Refugees Protection Act of Canada will be required to sign a personal client retainer agreement with an authorized representative.
8.2 The user acknowledges and consent to access by the authorized representatives and individuals appointed by them, to personal information and documents uploaded by the user to the websites and/or servers. The authorized representatives, under agreement with the company may assess the qualifications of the user for a Canadian immigration visa. Such assessments are performed on the server-end and are done on an as-is basis. These are preliminary eligibility assessments and do not guarantee the issuance of immigration visa or other document to the user.
10.1. No cancellation policy shall apply to customers that have agreed and accepted the Company`s Terms & Conditions.
11.Limitation of Liability
11.1. Neither the company, its officers, licensors, suppliers and employees shall be responsible for and disclaims all liability for any loss, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by the user or any third party, as a result of or which may be attributable to, (directly, indirectly or consequential), to the access and use of the website and platform, any information contained on the website, the user’s personal information or material and information transmitted over the Company’s system.
- English language shall prevail
- These Terms and Conditions have been translated into other languages for the convenience of the client. In the situation that there is any discrepancy in meaning between the other languages and the English terms, the English version shall prevail.
